PhysiologicPRISM is a cloud-based documentation and practice management platform designed for physiotherapists to:
- Document patient assessments using the structured PRISM framework
- Create and manage patient treatment records
- Track patient progress through follow-up documentation
- Generate comprehensive clinical reports
- Access smart documentation assistance that helps ensure complete, structured records
4. User Eligibility
To use this Service, you must:
- Be at least 18 years of age
- Be a licensed physiotherapist or healthcare professional
- Be affiliated with a recognized healthcare institute
- Have legal authority to enter into this agreement
- Comply with all applicable laws and regulations in your jurisdiction
4. Account Registration
4.1 Account Creation
- You must provide accurate, complete, and current information during registration
- You are responsible for maintaining the confidentiality of your password
- You must notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
4.2 Account Approval
- All new accounts require admin approval for security purposes
- We reserve the right to refuse service to anyone for any lawful reason
- Accounts may be suspended or terminated for violations of these terms
5. Acceptable Use Policy
5.1 Permitted Use
You may use the Service only for:
- Legitimate clinical assessment and treatment planning
- Managing your own patients
- Professional healthcare purposes within your scope of practice
5.2 Prohibited Activities
You may NOT:
- Share your account credentials with unauthorized individuals
- Access another user's account or patient records without authorization
- Input false, misleading, or fraudulent patient information
- Use the Service for any unlawful purpose
- Attempt to breach security measures or access unauthorized areas
- Reverse engineer, decompile, or disassemble the Service
- Use automated scripts or bots to access the Service
- Transmit viruses, malware, or other harmful code
- Interfere with the proper functioning of the Service
- Remove or modify any copyright, trademark, or proprietary notices
6. Professional Responsibility
6.1 Clinical Judgment
Important: This Service is a documentation tool, NOT a replacement for professional judgment.
- You are solely responsible for all clinical decisions and patient care
- Smart documentation features help structure and complete your clinical notes
- You must follow your professional standards, ethics, and licensing requirements
- In case of emergencies, follow appropriate emergency protocols
6.2 Patient Consent
- You must obtain appropriate consent from patients before entering their data
- You must inform patients about data processing and storage
- You are responsible for compliance with local healthcare regulations
7. Data Protection and Privacy
7.1 Your Responsibilities
- Ensure data accuracy and completeness
- Use the Service only on secure devices
- Log out after each session, especially on shared computers
- Report any suspected data breaches immediately
7.2 Our Responsibilities
- Maintain appropriate security measures (encryption, access controls)
- Comply with GDPR and HIPAA requirements
- Provide audit logs of data access
- Notify you of data breaches within 72 hours
8. Intellectual Property
8.1 Service Ownership
All content, features, and functionality of the Service are owned by PHYSIOLOGICPRISM LLP and protected by copyright, trademark, and other intellectual property laws.

- You grant us a license to store, process, and display your data solely to provide the Service

- Documentation assistance features use intelligent processing technology
- Patient data is anonymized before processing
- You are responsible for reviewing and approving all documentation content
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
- We do not guarantee uninterrupted or error-free operation
- We do not warrant that the Service will meet all your requirements
- We do not guarantee the accuracy of documentation assistance suggestions
- We are not liable for any clinical decisions based on the Service
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for patient outcomes or malpractice claims
- Our total liability is limited to the amount you paid for the Service (if any)
- Some jurisdictions do not allow these limitations, so they may not apply to you
11. Indemnification
You agree to indemnify and hold harmless PHYSIOLOGICPRISM LLP from any claims, damages, or expenses arising from:
- Your violation of these Terms of Service
- Your violation of any law or regulation
- Your clinical decisions and patient care
- Unauthorized access resulting from your account
12. Service Modifications
- We reserve the right to modify or discontinue the Service at any time
- We will provide reasonable notice of significant changes
- Continued use after changes constitutes acceptance
13. Termination
13.1 By You
- You may request account deletion at any time
- Patient records will be retained for 7 years (legal requirement)
- Your personal account data will be deleted after 30 days
13.2 By Us
We may suspend or terminate your account if:
- You violate these Terms of Service
- Your account is inactive for more than 12 months
- We receive a valid legal order
- We discontinue the Service
14. Dispute Resolution
14.1 Informal Resolution

14.2 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law provisions.
14.3 Arbitration
Any disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, wars, pandemics, internet outages, or government actions.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and PHYSIOLOGICPRISM LLP regarding the Service.
18. Payment and Refund Policy
18.1 Subscription Fees
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are quoted in Indian Rupees (INR) unless otherwise stated
- Fees are subject to applicable taxes (GST)
- Payment is processed securely through our payment partners
18.2 Free Trial
- New users receive a 14-day free trial with limited features
- No credit card required for the free trial
- Trial automatically expires after 14 days unless you subscribe
- Trial data is retained for 30 days after trial expiration
18.3 No Refund Policy
All sales are final. We do not offer refunds for any subscription fees paid.
- No refunds will be provided for any reason, including but not limited to:
- Change of mind after purchase
- Failure to use the Service
- Cancellation before the end of the subscription period
- Dissatisfaction with the Service
- Technical issues on your end (e.g., internet connectivity)
- You are responsible for understanding the features and limitations before subscribing
- We encourage you to use the 14-day free trial before purchasing a paid subscription
18.4 Cancellation
- You may cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- You will continue to have access until the end of the paid period
- No partial refunds will be provided for unused time in the billing period
- After cancellation, you can resubscribe at any time
18.5 Price Changes
- We reserve the right to change subscription fees at any time
- Price changes will be communicated at least 30 days in advance
- Existing subscribers will be grandfathered at their current rate for one billing cycle
- Continued use after price change constitutes acceptance
